Explicit and implicit belief-based gender discrimination: a hiring experiment

Inhalt: Understanding discrimination is key for designing policy interventions that promote equality in society. Economists have studied the topic intensively, typically taxonomizing discrimination as either taste-based or (accurate) statistical discrimination. To enrich this taxonomy, we design a hiring experiment that rules out both of these sources of discrimination along the gender dimension. Yet, we still detect substantial discrimination against women. We provide evidence of two forms of discrimination, explicit and implicit belief-based discrimination. Both rely on statistically inaccurate beliefs but differ in how clearly they reveal the decision-maker's gender bias. Our analysis highlights the central role played by contextual features of the choice environment in determining whether and how discrimination will manifest. We conclude by discussing how policy makers may design effective regulation to address specific forms of discrimination.

Inhalt: Geschlechter, sexuelle Orientierungen und die damit verbundenen Lebensweisen sind heterogen. Inwieweit Menschen ihr Geschlecht, ihre Sexualität und ihre Lebensform selbstbestimmt und frei leben können, und mit welchen gesellschaftlichen Ressourcen, Teilhabechancen und Diskriminierungen dies verbunden ist, beeinflusst ihre Lebenslagen und damit auch ihre gesundheitliche Situation. Es wurde ein narratives Review zur gesundheitlichen Situation von lesbischen, schwulen, bisexuellen, trans- und intergeschlechtlichen Personen (LSBTI) durchgeführt und dazu internationale und deutsche Reviews, Metaanalysen und bevölkerungsbezogene Studien herangezogen. Der Beitrag beschreibt schlaglichtartig den Stand der rechtlichen, gesellschaftlichen und medizinischen Anerkennung in Deutschland sowie die gesundheitliche Lage von LSBTI-Personen. Die rechtlichen Rahmenbedingungen in Deutschland haben sich für homo- und bisexuelle Menschen schrittweise verbessert, während für trans- und intergeschlechtliche Personen aus Sicht vieler Akteur*innen bezüglich sowohl der medizinischen als auch rechtlichen Anerkennung noch große Defizite bestehen und wissenschaftliche Erkenntnisse noch ungenügend Eingang in die medizinische Praxis gefunden haben. Die verfügbaren Daten zur gesundheitlichen Situation von LSBTI-Personen verweisen auf Handlungsbedarfe im Bereich der psychischen Gesundheit und der Gesundheitsversorgung. Die Datenlage ist jedoch sehr lückenhaft und lässt kaum Aussagen über die allgemeine gesundheitliche Lage und über gesundheitliche Ressourcen von LSBTI-Personen zu. Für die konkrete Planung und Umsetzung von Maßnahmen und die differenzierte Beschreibung der Situation in Deutschland bedarf es eines Ausbaus der Datengrundlagen, nicht zuletzt auch in bevölkerungsrepräsentativen Erhebungen.

Inhalt: Sex, gender and sexual orientation are diverse, as are the ways of living associated with them. The extent to which people can live a free and self-determined life according to their own body, gender, sexuality and way of life influences their social resources, opportunities for participation and discrimination and has an influence on their life situation and health. A narrative review of lesbian, gay, bisexual, transgender and intersex (LGBTI) health was conducted including international and German reviews, meta-analyses and population-based studies. The focus of this article is the legal, social and medical recognition as well as health status of LGBTI people in Germany. While the legal framework in Germany for homosexual and bisexual people has gradually improved, many civil society stakeholders have pointed to major deficits in the medical and legal recognition of transgender and intersex people. In addition, scientific findings frequently have not yet found its way into medical practice to an adequate extent. Available data on LGBTI health indicate a need for action in the areas of mental health and health care provision. However, due to a lack of comprehensive data, conclusions cannot be drawn on the general health situation and health resources of LGBTI people. For the concrete planning and implementation of measures as well as the differentiated portrayal of the situation in Germany, the databases must be expanded, not least via population-representative surveys.

Changing Gender Norms in Islam Between Reason and Revelation

Inhalt: Women‘s movements in Islamic countries have had a long and arduous journey in their quest for the realization of human rights and genuine equality. The author examines whether discriminatory laws against women do in fact originate from Islam and, ultimately, if there is any interpretation of Islam compatible with gender equality. She investigates women’s rights in Iran since the 1979 Revolution from the perspectives of the main currents of Islamic thought, fundamentalists, reformists, and seculars, using a sociological explanation. The disputes about human reason and its relation to revelation can be traced in various Islamic schools of thought since the eighth century AD. However, the disputes have intensified since the eighteenth century when Muslims faced challenges to their faith and social order, brought about by modernity and enlightenment from the West. There were various reactions within the Islamic world. These reflections produced different interpretations of Islam that can be categorized based on their understanding of how compatible Islamic laws are with a specific time and space; as well as how they define the relationship between human reason and revelation. The three major interpretations of Islam within a spectrum are on the far right fundamentalists, in the middle reformists, and on the far left secularists; each having diverse views on the legitimacy and applicability of all Islamic law in modern times, and consequently having various perspectives on justice and gender equality. Accordingly, the author aims to investigate the different interpretations on Islam to find out which interpretations are compatible with the global norms of justice, and hence in accord to women’s rights and gender equality. In order to analyze the Islamic thought flows through a sociological perspective, a theoretical model is proposed based on theories of sociology of religion (Peter Berger and Thomas Luckmann), Structuration theory (Anthony Giddens) and struggles related to universal norms of justice (Nancy Fraser, Axel Honneth, Seyla Benhabib). According to this theoretical model, there is a dialectical relationship between individual and structure. Religion, as a factor of structure, defines a framework of interaction for individual agents in personal and social life. Religion also offers a value and meaning system for human beings. On the other hand, human beings examine the patterns of interaction through 'reflexive monitoring,' and employing human reason and rational explanation. Therefore, human beings do not passively accept all patterns of interaction. In this model of dialectical relationship between individual and structure, justice means providing equal access to political, economic, and cultural resources in society and in the family. On this matter, the Universal Declaration of Human Rights and the Convention on the Elimination of all Forms of Discrimination Against Women provide practical and universal criteria for the protection of human and women's rights, and ensure gender equality in society. Following the theoretical model, the research aims to reconstruct the main interpretations of Islam in three core issues of Islamic law, human reason, and women’s rights considering universal norms of justice.

Wie liberale Positionen und Argumente für die Diskriminierung und Ungleichbehandlung von Frauen in Zusammenhang mit einer Politisierung kultureller und ethnischer Konfliktlinien genutzt werden, zeigt der Beitrag exemplarisch an zwei unterschiedlichen Fallbeispielen. So wird zum einen am Beispiel des vorläufigen Parteiprogramms der Alternative für Deutschland (AfD) die Konstruktion autoritärer Geschlechterdiskurse in Verbindung mit einem wertkonservativen Familienbild analysiert. Inhalt: "Focusing on the current renaissance of authoritarian discourses and practices we analyze the effects of gendered power relations in society. We base our analysis on a critique of current research on right wing populism and autocracy research, which focuses primarily on state dominated institutions, official government apparatuses and political decision-making processes. In contrary, we take up a bottom-up perspective and advocate a concept of feminist analysis that is rooted in a broader concept of civil society, analyzing gender relations as societal power structures from a non-essentialist governmentality and post-structuralist perspective. The core is an understanding of authoritarian as a program of action that takes up universalist values of equality and justice and reinterprets them as instruments for discrimination and exploitation in linking different discourses and practices. Based on two case studies we show how liberal positions and arguments for the discrimination and inequality of women are used in the context of the politicization of cultural and ethnic conflict lines. Using example of the provisional program of the alternative for Germany (AfD) we analyze the construction of authoritarian gender discourses in connection with a value-conservative family. The example of the transitional society of Chile shows how the normalization of authoritarian discourse takes place and how civil society women’s organizations are instrumentalized for democratic opening and closing processes." Gender and the right to non-discrimination in international human rights law

Inhalt: Discrimination against women based on the fact that they are women is a deeply rooted practice in all societies. However, the level of discrimination varies greatly with the level of development of the given society and strongly influences and vice versa it is influenced by the status of women in a given society. Addressing this gender-based discrimination is a difficult task because it is closely linked to the concept of equality, and state’s action and inactions. The article establishes that the States parties’ obligation is to ensure that there is no direct or indirect discrimination against women in their laws, sanctions, and other remedies and those women are protected against discrimination in the public, as well as, in the private spheres.
