Living Together v. Living Well Together: a Normative Examination of the SAS Case

Inhalt: The European Court of Human Rights decision in SAS from France illustrates how a policy and national mantra that ostensibly aims to enhance inclusiveness, ‘living together’, is legally deployed in a manner that may have the opposite effect. In essence, despite acknowledging the sincerity of SAS’s religious practice of wearing the niqab, and her agency in making the decision to do so, the Court focuses on radicalism and women’s oppression amongst Muslims. Taking the
notion of living together as the beginning point, the paper explores the normative assumptions underlying this notion as illustrated in the judgment of the Court. An alternative approach, drawing on the work of Derrida for the notion of
‘living well together’ will be proposed and its implications for social inclusion explicated. The paper’s aim is to move beyond the specific example of SAS and France to argue that the SAS pattern of identifying particular values as ‘national values’, the deployment of those values through law, policy and public discourse, and their exclusionary effects is playing out in a number of Western democracies, including Canada, the country with which the author is most familiar. Because
of this widespread dissemination of values and their framing as representative of who ‘we’ are, there is a pressing need to consider the potentially alienating effects of a specific manifestation of ‘living together’ and an alternative model of ‘living well together’. (author's abstract)

Inhalt: "Dieser Beitrag geht zwei grundlegenden Fragen nach: zum einen, ob Frauen bei Kommunalwahlen, bei denen Kumulieren und Panaschieren möglich ist, gezielt nach unten gewählt -und somit durch die Wählerschaft diskriminiert- werden, und zum anderen, ob ein vorhandener Doktortitel der KandidatInnen den Wahlerfolg, unabhängig vom Geschlecht, im Vergleich zu Nicht-Promovierten erhöht. Die Analysen der Kommunalwahlen in 74 Klein- (20 000 bis 50 000 EinwohnerInnen) und Großstädten (mehr als 100 000 EinwohnerInnen) anhand der Parteilisten mit fast 16 000 KandidatInnen zeigen eine Benachteiligung von Frauen gegenüber den (männlichen) Kandidaten durch die Wählerschaft, die sich allerdings nur in Kleinstädten, nicht jedoch in Großstädten äußert. Ein Doktortitel begünstigt den relativen Wahlerfolg von Frauen und Männern gegenüber Nicht-Promovierten wie erwartet, wobei es keine signifikanten Differenzen im Wahlerfolg zwischen Frauen und Männern mit Doktortitel gibt. Inhalt: "This article addresses two basic issues: Whether women are discriminated by voters in local elections when the electoral system allows accumulation and cross-voting and whether candidates with a PhD achieve better relative electoral success than candidates without a PhD, regardless of the candidate's gender. An analysis of local elections in 74 small towns (20 000 up to 50 000 residents) and large cities (more than 100 000 residents) with nearly 16 000 candidates showed that women are discriminated by voters in small towns, but not in big cities. Candidates with a PhD are more successful in elections than candidates without a PhD. However, there are no significant differences between the electoral success of women and men with a doctorate. The hypothesis and results will be discussed as reflected in current research results." (author's abstract)

Inhalt: There are many instances of crime especially against women go unreported in India. large number of dark figure crime index reflecting on country’s law and order situation, offences against women like domestic violence, Rape, sexual violence, Women Trafficking, Molestation, Murders, Dowry Deaths, and other violent crimes often impacting on society and they are seriously impacting on social condition. Women victim’s in this particular offences faces many problems throughout the investigation and criminal justice trail processes, law enforcement is more responsible in an investigation. In India some of the offences like Dowry system, child marriages, are still affecting the society; Most of this kind of offence is rarely known to other countries. Feminism in India has been high spot in the recent developments. In India there is need of the active participation of feminism, which will be more gainful in the prevention of Offences against Women. Social Exclusion of Australian Childless Women in Their Reproductive Years

Inhalt: Research suggests Australian childless women are at risk of pronatalism-driven social exclusion. This exploratory, mixed methods, cross-sectional study described and explored the social exclusion of Australian childless women aged 25 to 44
years, and asked: what are the nature and extent of social exclusion of childless women; and do the nature and extent of exclusion vary for different types of childless women? A total of 776 childless female Australian residents aged 25 to 44 years completed a self-administered questionnaire. Quantitative data were collected on childlessness types, indicators of exclusion and perceived stigmatisation and exclusion due to being childless. Data were analysed using descriptive
statistics, One Way ANOVAs and Kruskal Wallis Analysis of Ranks. Qualitative data on childless women’s experiences were inductively thematically analysed. Findings suggest societal-level pronatalism drives exclusion of Australian
childless women. While exclusion occurs in all domains of life, childless women experience more exclusion, and perceive more exclusion due to being childless, in the social and civic domains than the service and economic domains. Circumstantially and involuntarily childless women, followed by voluntarily childless women, perceive more exclusion due to being childless than undecided and future childed women. Experiences are influenced by the nature of women’s ‘deviance’ from pronatalism. (author's abstract)

Inhalt: "Bezahlte Care- und Hausarbeit, die von MigrantInnen geleistet wird, hat seit den 1990er-Jahren immer weitere Verbreitung im globalen Maßstab erreicht. Im Bereich der Altenpflege und -versorgung entwickelten sich besonders prekäre Arbeitsarrangements und migrantische Arbeitskräfte füllen jene Care Lücken, die nicht mehr durch unbezahlte Arbeit abgedeckt werden. Der Beitrag zeigt am Beispiel der 24 Stunden Pflege in Österreich, dass es dabei auch zur systematischen Ausbeutung durch europäische Wohlfahrtsstaaten kommt. Indem dort Arbeitsrecht ausgesetzt wird und die Unterschreitung von Mindestlöhnen durch Kollektivvertragslöhne rechtlich abgesichert werden, wird die geschlechtsspezifische Ausbeutung migrantischer Hausangestellten legalisiert. Inhalt: "Paid domestic labour carried out by migrants has increased globally since the 1990s. Especially in the area of care for the elderly, working conditions are extremely precarious and migrants are recruited when unpaid family care is missing. The paper reveals that European welfare states systematically exploit migrants demonstrating the example of 24 hour care in Austria. Suspending labour regulations and undermining minimum wages through collectively bargained wages, gender specific exploitation of migrant domestic workers is legalized. Inhalt: The study intends to comprehend the underrepresentation of women on positions of power and
academic excellence in academia. The study explained the role of exploitation and harassment,
which might hinder, when women were trying to climb to top hierarchical position. The majority
of women supervised by male heads, sexual harassment could be used as a glass ceiling to hamper
women to reach top hierarchal level. The majority participants were working on lower academic
and administrative hierarchy; they were experiencing harassment throughout the hierarchical
level. Similarly, they considered that harassment could contribute to the underrepresentation of
women at academic excellence and a position of power.

Inhalt: Im Jahr 1997 wurden die Prinzipien Gender Mainstreaming und Antidiskriminierung auf Grund von Geschlecht, 'Rasse', ethnischer Herkunft, Religion/Weltanschauung, Behinderung/Beeinträchtigung, Alter und sexueller Orientierung im Amsterdamer Vertrag verankert. Die Einleitung zum Schwerpunktheft bilanziert zwanzig Jahre nach der Verabschiedung die Wirkungen dieser vertraglichen Verankerung und kommt dabei zu einem gemischten Fazit. Einerseits hat sich das supranationale EU Gender- und Antidiskriminierungs-Regime dank wachsender Aufmerksamkeit für Gleichstellung in den verschiedenen Politikfeldern und neuer rechtlicher Grundlagen für vielfältige Diskriminierungsgründe deutlich über die damaligen Grenzen der Beschäftigungs- und Sozialpolitik hinaus entwickelt. Andererseits haben sich die Erwartungen an Gender Mainstreaming als transformative Strategie trotz feministischem Aktivismus und gleichstellungsorientierter Forschung nicht erfüllt, und die Mitgliedsstaaten haben die Entwicklung eines Antidiskriminierungs-Regimes auf 'softe' Politikinstrumente und lediglich zwei bindende Richtlinien begrenzt. Darüber hinaus blieben die beiden Politikprozesse - Gender Mainstreaming und Antidiskriminierung - institutionell und strategisch unverbunden. Anstatt Intersektionalität zu 'mainstreamen', werden Diskriminierungsgründe separat behandelt und Geschlechtergleichstellung scheint in die reaktive Politiklogik von Antidiskriminierung absorbiert zu werden, während Gender Mainstreaming oft darauf begrenzt bleibt, Männer und Frauen als zwei feststehende Kategorien einzufügen. Die Osterweiterung und die Finanz- und Legitimitätskrise der EU haben zudem eine soziale und politische Konstellation hervorgebracht, die der Entwicklung einer alternativen Gleichstellungsstrategie nicht gerade förderlich ist. Inhalt: In 1997 the principles of gender mainstreaming and anti-discrimination based on sex, racial or ethnic origin, religion or belief, disability, age or sexual orientation were enshrined in the Treaty of Amsterdam. The introduction to this special issue takes stock of the results twenty years after and finds mixed results. It argues that a supranational EU gender and antidiscrimination regime has developed beyond the original limitations to discrimination between women and men in employment and social security, thanks to the attention to gender equality in other policy domains and the adoption of legal and political instruments dealing with other grounds for discrimination. However, in spite of feminist activism and research, gender mainstreaming has not fulfilled the expectations as a transformative strategy, and member states have limited the development of an antidiscrimination regime to a set of ever softer policy instruments and two binding legal instruments. Importantly, the processes of gender mainstreaming and antidiscrimination remain disconnected institutionally and strategically. Instead of mainstreaming the concept of intersectionality, antidiscrimination policies continue to treat grounds for discrimination separately, gender equality seems to be absorbed by the logic of antidiscrimination as a reactive policy approach, and gender mainstreaming is reduced to inserting woman and man as two fixed categories. Unfortunately, the eastern enlargement, the financial crisis and the legitimacy crisis faced by the EU have created a social and political constellation, which is not propitious for the development of an alternative equality strategy.
