Inhalt: Der vorliegende Band ist das Ergebnis einer Kooperation des Instituts für Legal Gender Studies mit dem Frauenbüro der Arbeiterkammer OÖ zur Beweiserleichterung im Gleichbehandlungsrecht. Um Diskriminierungsopfern den Zugang zum Recht zu erleichtern, sieht das Antidiskriminierungsrecht eine Verschiebung der Beweislast vor. Eine Diskriminierung ist vor Gericht nur glaubhaft zu machen. Diese Beweisregel wirft in der Praxis jedoch erhebliche Vollziehungsprobleme auf: Nicht selten spielen bei abweisenden Gerichtsurteilen geschlechtsspezifische Alltagsannahmen und Stereotype bei der Sachverhaltsfeststellung eine Rolle, insbesondere bei sexueller Belästigung.
In diesem Buch wird die Beweislastregel des GlBG einer kritischen Analyse unterzogen.
