Inhalt: Der Handkommentar gibt Antworten auf die wichtigen arbeits- und sozialrechtlichen Fragen der Elternschaft. Die juristischen Probleme der zum 1.1.2018 in Kraft tretenden umfangreichen Änderungen des völlig neustrukturierten MuSchG, wie z.B.
- der erweiterte Geltungsbereich auf sozialversicherungsrechtliche Beschäftigungsverhältnisse, arbeitnehmerähnliche Frauen, Studentinnen und Praktikantinnen,
- die neugestalteten Beschäftigungsverbote zur Verbesserung/Erleichterung von Tätigkeiten von Frauen während der Schwangerschaft,
- der vorverlagerte und gänzlich neue Kündigungsschutz nach einer Fehlgeburt,
- die verlängerten Mutterschutzfristen bei der Geburt eines behinderten Kindes,
- die neu eingeführte Höchstdauer für die Gewährung von Stillzeiten,
- die Vereinfachung der Leistungen Mutterschutzlohn und Mutterschutzgeld sowie
- die Änderung bei Beamten durch Aufhebung der Eigenverwaltung des MuSchG werden detailgenau für die Praxis erläutert.
Die zum 1. Juli 2017 in Kraft tretenden Änderungen des Unterhaltvorschussgesetzes mit der Ausweitung des Vorschusses auf Kinder bis zum 18. Lebensjahr sind in den Kommentierungen ebenso berücksichtigt wie die Änderungen des EStG, des BKGG, des PflegeZG und des FPflZG.
Mitkommentiert ist außerdem das neue Bayerische Betreuungsgeldgesetz mit Referenzcharakter für zukünftige Landesgesetze auch in anderen Bundesländern.

Paid Parental Leave and Families’ Living Arrangements

Inhalt: We examine how a paid parental leave reform causally affected families’ living arrangements. The German reform we examine replaced a means-tested benefit with a universal transfer paid out for a shorter period. Combining a regression discontinuity with a difference-in-differences design, we find that the reform increased the probability that a newborn lives with non-married cohabiting parents. This effect results from a reduced risk of single parenthood among women who gained from the reform. We reject the economic independence hypothesis and argue that the reform effects for those who benefited from the reform are consistent with hypotheses related to the improved financial situation of new mothers after the reform and increased paternal involvement in childcare.

Heutige Väter wollen nicht mehr nur auf ihre Funktion als Familienversorger reduziert werden, sondern sich aktiv an der Fürsorge ihrer Kinder beteiligen. Warum halten dennoch viele Familien an der traditionellen Aufteilung von Sorge- und Erwerbsarbeit fest? Welche Männlichkeitskonzepte werden von der Gesellschaft propagiert und warum fällt es so schwer diese herkömmlichen Modelle hinter sich zu lassen? Inhalt: “May” children, holiday babies and post-tenure pregnancies: these are some of the labels attached to women’s choices of having children in an academic environment. Academic women seem to share a common burden in scheduling their maternity plans: to survive in academia and advance through the faculty ranks, women tend either to give birth during vacation time, or to postpone their motherhood status to the end of their probation period and the achievement of tenure.
The end result is, generally, an underrepresentation of women in higher academic positions (also known as the “leaking pipe problem”), lower salaries, lower research outcomes and rates of promotion, lower fertility, and higher rates of family dissolution – while family and children seem to have either no impact or even a positive effect on the patterns of men’s performance in the academic ranks. Thus, motherhood and professional achievements appear as conflicting goals even for women in academia, an environment that is usually praised for its flexibility in terms of working hours and thus family friendliness.
In this paper, Vera Troeger, Professor of Quantitative Political Economy at the University of Warwick and Research Theme Leader at the Centre for Competitive Advantage in the Global Economy (CAGE) looks at the effect of maternity benefits on the career opportunities of women in academia.
