The findings of six research projects fall into four clusters that mirror the concerns of policy makers: gender inequalities in labour market participation; labour market segregation and the nature of 'women's work'; flexible employment, family-friendly work and work-life balance; welfare and social exclusion; and the formulation and implementation of gender equality policies. The research reviewed highlights several gaps in our understanding of labour market dynamics as they affect gender equality and policy formulation. The need for further research has been identified on specific topics, including a systematic evaluation of flexible work forms on gender equality, developing new understandings of 'skill', and social protection and social exclusion." Inhalt: "The aim of this article is to analyse the development of the concepts of equal opportunities between men and women and gender mainstreaming with regard to a new policy approach taken outside the traditional community method and to raise the question to what extent these policy instruments can be considered as a 'new tool' to combat gender discrimination. The European Employment Strategy (EES) and the Open Method of Coordination (OMC) are two examples of an instrument outside the community method, which tries to increase the recognition of the gender dimension of the labour market and to improve the initiatives taken in the interrelated field of social inclusion of women by the use of 'soft' policy instruments and voluntarist procedures. The paper illustrates the development of the concept of equal opportunities between men and women and gender mainstreaming under the EES and the OMC; more precisely, the paper seeks to demonstrate that the concepts of equal opportunities between men and women and gender mainstreaming cannot be addressed by reference to harmonisation instruments exclusively, but need, due to the diverse approach towards gender equality on a national level, a decentralised approach as it is offered by the coordination instrument, which should be understood as a complementary tool of integration." Im Gesetzgebungsverlauf werden geschlechterpolitische Wirkungsannahmen und die Beteiligung der Geschlechter an der Entscheidungsfindung beobachtet. Die rechtliche Geltung des Gender-Mainstreaming-Prinzips (GM) nach deutschem und nach Europarecht wird belegt. Entgegen der Annahme, GM sei eine unverbindliche Absichtserklärung, erweist sich, dass das Erfordernis der Geschlechtergerechtigkeit einen verbindlichen Rationalitätsmaßstab für gesetzgeberische Entscheidungsprozesse darstellt. Anhand internationaler Beispiele werden Empfehlungen unterbreitet, wie die familienpolitische Einkommenssteuergesetzgebung dem GM wirksam und angemessen Rechnung tragen kann: Sie muss Männern wie Frauen gleichermaßen Elternschaft und qualifizierte Berufstätigkeit erlauben und hierzu steuerliche Maßnahmen im Zusammenhang mit anderen Maßnahmen der Familienförderung - wie Kinderund Seniorenbetreuung, familiengerechte Arbeits- und Arbeitszeitgestaltung usw. - ergreifen."
