Inhalt: This paper places women at the centre of analysis, examining the potential and promise of the African Charter on Democracy, Elections and Governance (ACDEG) in the advancement of women’s political rights. This is a highly under-researched topic, necessitating a mapping of the current political landscape for women and an understanding of how ACDEG addresses these challenges as well as provides opportunities for advancing women's political participation. This paper argues that ACDEG provides a good basis and framework to operate from for member states - some of whom already have suitable policies, and more importantly suitable practices, in place that emerge from a range of normative frameworks, including the Maputo Protocol. ACDEG complements these frameworks and makes a further case for women's full and meaningful participation in public and private life by obligating states to take concrete steps to guarantee women's political rights. Considering this, the paper identifies prospects for women's rights activists and organisations to invoke ACDEG and monitor its implementation in the move towards the realisation of African women's political rights.

Girls' Exploitation in the triple border among Argentina, Brasil and Paraguay: between colonialism and human rights narratives

Inhalt: This article focuses on the narratives and underlying ideologies that enable the persistence of girls’ sexual exploitation in the region of the Triple Border among Argentina, Brasil and Paraguay, where field work was conducted. We argue that the persistence of colonial practices has contributed to the reproduction of subalternity positions for girls and women -especially from impoverished sectors- enforced by the conservative and patriarchal discourse present in many countries of the region. This scenario enables the persistence and naturalization of certain practices that became "invisible" or even accepted and justified as being “cultural”. In this sense, we propose that human rights narrative, although being a Eurocentric construction, can comprise a platform for raising issues on gender inequality and all forms of violence and exploitation taking place in the peripheral regions of the world.

Inhalt: Am 21. April 2017 veranstaltete das Deutsche Institut für Menschenrechte (DIMR) gemeinsam mit dem Bundesministerium für Familie, Senioren, Frauen und Jugend (BMFSFJ) zwei Fachgespräche zur Vorbereitung der 8. Sitzung der UN Open Ended Working Group on Ageing (OEWG-A). Die Themen die während der 7. Sitzung ausgewählt wurden waren Diskriminierung älterer Menschen und Gewalt, Misshandlung und Vernachlässigung Älterer.
Ziel der Fachgespräche war es Erkenntnisse, Erwartungen und gute Beispiele aus Deutschland zu bündeln, damit diese dann von den Vertreter_innen der deutschen Regierung, der Zivilgesellschaft und des DIMR in die achte Sitzung der UN-Arbeitsgruppe eingebracht werden konnten. Die in beiden Fachgesprächen entwickelten Eckpunkte bildeten Grundlagen zur Fortentwicklung der koordinierten Position der EU-Mitgliedstaaten.
Es nahmen Vertreter_innen aus der Wissenschaft, der Praxis, der Zivilgesellschaft, den Verbänden, den Aufsichtsbehörden, den zuständigen Ressorts und dem Deutschen Institut für Menschenrechte teil.
Die vorliegende Dokumentation stellt die Hintergründe des UN-Prozesses zur Stärkung der Menschenrechte Älterer vor, dokumentiert die Ergebnisse der beiden deutschen thematischen Fachgespräche zur Vorbereitung der 8. Sitzung der OEWG-A und informiert über die Ergebnisse der Sitzung der UN-Arbeitsgruppe.

Inhalt: Discrimination against women based on the fact that they are women is a deeply rooted practice in all societies. However, the level of discrimination varies greatly with the level of development of the given society and strongly influences and vice versa it is influenced by the status of women in a given society. Addressing this gender-based discrimination is a difficult task because it is closely linked to the concept of equality, and state’s action and inactions. The article establishes that the States parties’ obligation is to ensure that there is no direct or indirect discrimination against women in their laws, sanctions, and other remedies and those women are protected against discrimination in the public, as well as, in the private spheres.

Inhalt: "Das Konzept der Anerkennung bezieht sich in den Internationalen Beziehungen zumeist allein auf Staaten, das heißt auf die wechselseitige Anerkennung unterschiedlicher Identitäten, Kulturen und religiöser Zugehörigkeiten. In der politischen Theorie dominiert zwar zunächst Honneths Konzept der Anerkennung als dominantes Prinzip der Gestaltung sozialer zwischenmenschlicher Beziehungen, es findet sich jedoch auch das Konzept der Anerkennung von Rechten und Menschenrechten. Das Arbeitspapier fokussiert diesen Ansatz und zeigt, dass mit Hilfe dieser Dimension der Anerkennungsgerechtigkeit erklärt werden kann, wie bestimmte Formen von Menschenrechten sich sozial, politisch und rechtlich als Normen verankern können. Mit Hilfe des Ansatzes von Jens Bartelson, der Anerkennung in ihren moralischen/sozialen, politischen und rechtlichen Varianten für die staatliche Ebene differenziert, wird argumentiert, dass sich der Fall der Anerkennung sexualisierter geschlechtsspezifischer Gewalt (sexual gender-based violence (SGBV)) als Straftatbestand und somit Teil des internationalen Strafrechts erklären lässt. Erst nachdem die transnationale Debatte durch Nicht-Regierungsorganisationen neu gestaltet und Rechtslücken aufgezeigt worden waren, fanden sich Staaten, die das Ansinnen, sexualisierte Gewalt durch den Internationalen Strafgerichtshof verfolgen zu lassen, unterstützten. In den Verhandlungen zum Rom-Statut erfuhren die Befürworterinnen einer weiten Definition solcher Gewaltformen jedoch unerwarteten Widerstand von einigen Staaten, die Gerechtigkeitsargumente geltend machten." Inhalt: "Recognition is a multi-faceted concept. In IR theory it also seems to be an undervalued concept as it only focuses on the relationship between states and the mutual recognition of identities as well as cultural and religious differences. Honneth's concept of recognition as leading principle of social relations dominates the debates in political theory. Besides this focus on intersubjective agency, the recognition of rights and human rights also plays a role in political theory. The working paper focuses on this approach and argues that the emergence of certain human rights can be grasped through drawing on concept of recognition of rights. The paper therefore relies on the approach of Jens Bartelson who summarizes the debate on states’ recognition under the heading of 'three dimensions of recognition': the moral/social, political and legal recognition. The working paper draws on this conceptual clarification and relates it to the recognition of rights. It argues that the recognition of sexual gender-based violence (SGBV) as part of international law can be explained by relying on Bartelson's concept as heuristic. The working paper traces the norm emergence process of SGBV from its social, political and its final legal recognition as part of the Rome Statute of the International Criminal Court (ICC). Nevertheless, the attempt of the NGO-network to strengthen individual women’s rights during the negotiations of the Rome Statute was opposed by certain states blocking a broader definition of gender-based crimes." Inhalt: Der Beitrag behandelt das Thema 'Gewalt gegen Frauen und Mädchen' in den Politiken der Vereinten Nationen und deren Frauenrechtsinstrumenten aktuell und in ihrer geschichtlichen Entwicklung. Aus einer empirischen Perspektive der aktiven Prozessbeobachtung und -partizipation wird mittels Dokumentenanalyse schwerpunktmäßig das als 'historisch' bezeichnete Abschlussdokument der 57. Sitzung der Frauenstatuskommission der Vereinten Nationen 2013 besprochen. Dessen Inhalte umfassen sowohl die Ursachen und Hintergründe von Gewalt gegen Frauen und Mädchen als auch Empfehlungen für Nationalstaaten, Institutionen, die Zivilgesellschaft und private Akteure, die sie sich zur Umsetzung vorgenommen haben. Das Abschlussdokument wird in seiner Bedeutung als Menschenrechtsinstrument und im Zusammenhang mit der Frauenrechtskonvention untersucht. Im Ausblick wird auf die Verankerung der Frauenrechte im zukünftigen Rahmen der Post-2015-Entwicklungsagenda der Vereinten Nationen eingegangen. (Autorenreferat)
Inhalt: This article discusses the issue of 'violence against women and girls' within the context of policies of the United Nations and their women's rights instruments, concerning the current situation and in a historical framing. From an empirical perspective, the active process of observation and of participation is being referred to with means of document analysis, the so-called 'historic' final document of the 57th Session of the UN Commission of the Status of Women in 2013 is reviewed. Its content includes both the background and causes of violence against women and girls as well as recommendations for nation-states, institutions, civil society, and private actors that focus on realization and implementation. The final outcome document is assessed as an instrument for human rights in relation to the Convention of the Elimination of All Forms of Discrimination Against Women. In an outlook on future deliberations, the anchoring of women's rights in the framework of the United Nations post-2015 agenda is also discussed. (author's abstract)
