A rights-based approach to board quotas and how hard sanctions work for gender equality

Inhalt: This article examines whether progress in women’s access to decision-making positions is best achieved through increased levels of development or targeted actions. Drawing on European data for the period 2006–2018, the article examines the association between how gender equal a country is and legislated measures such as board quotas with women’s representation on boards. The analysis then explores how this can be nuanced by differentiating between hard sanctions, soft sanctions and codes of governance. It shows that board quotas cannot be relied upon as instruments of progress independently of a contextual environment that is more gender equal. Furthermore, board quotas with hard sanctions work best, followed by codes of governance, particularly when associated with higher gender equality. However, board quotas with soft sanctions are associated with results that are only marginally better than not having any measure in place. The article concludes that for further and faster progress to be made, introducing legislated board quotas shows great potential, though only in combination with striving for a gender equal society and using hard sanctions. The results call for organizations not to lose focus on ‘rights’ at the expense of the more palatable ‘business case’ for board quotas when striving for equality on corporate boards.

Are Studies on Gender Diverse Boards Biased by Using the Book Value of Debt?

Inhalt: We analyze if the empirical research on the consequences of a board’s gender diversity is affected by a specific measurement bias in Tobin’s Q: the value bias in corporate debt (VBCD). Book values of corporate debt are a more downward biased proxy of the market values of debt if increased board’s gender diversity comes with a reduction in corporate risk-taking. Nevertheless, the market values of corporate debt are frequently approximates by their book value when measuring Tobin’s Q.
We first show the VBCD using bond market data and its link to higher board’s gender diversity. Second, we replicate two recent studies on the link between a board’s gender diversity and the firm’s performance. We show how the VBCD impacts the estimations and inferences. Coefficient sizes and significance levels are both affected by the VBCD. Third, we recommend an easy-to-implement correction that explicitly accounts for risk changes in the values of corporate debt.

Dies wird insbesondere deutlich, wenn die wirkung von mehr weiblichen Führungskräften auf den wert des gesamten unternehmens untersucht wird, und nicht nur der effekt auf den wert des eigenkapitals, oft als „Börsenwert“ bezeichnet. um dies zu zeigen analysierten riepe und Yang anhand von Marktpreisen börsennotierter unternehmensanleihen die wechselwirkung zwischen dem Anteil weiblicher Führungskräfte in kontrollgremien, dem unternehmensrisiko und dem wert der unternehmensverschuldung.
Dabei konnten sie zeigen, dass unternehmensanleihen an wert gewinnen, wenn der Anteil von Frauen in diesen Gremien steigt. Mit diesen erkenntnissen vollzogen sie zudem zwei ältere Studien zum thema nach und kamen zu einem neuen, positiven ergebnis, was die Frauenquote betrifft.
Sind Frauen in Führungspositionen „gut fürs Geschäft“?
norwegen hat bereits 2006 eine verbindliche Geschlechterquote für mehr Frauen in Leitungsgremien eingeführt. 2018 erließ kalifornien als erster uS-Bundesstaat eine ähnliche regelung. Der effekt ist umstritten. Befürworter von Geschlechterquoten-Gesetzen nutzen häufig das „Business case“ Argument: Geschlechtervielfalt sei gut für die gesamte wirtschaft wie auch unternehmen. Auch Bundesfamilienministerin Giffey warb dafür, dass Frauen in Führungsspitzen „gut fürs Geschäft“ seien. Studien scheinen diese Behauptung auf den ersten Blick jedoch nicht zu stützen. einige dieser Studien stellten fest, dass sich Gremien mit Geschlechterquoten negativ auf die Gewinne von unternehmen auswirken. In ihrer früheren Studie „women Directors, Firm performance and Firm risk: A causal perspective“ hatten auch riepe und Yang gemeinsam mit koautorinnen zumindest kurzfristig einen negativen effekt auf den unternehmensgewinn und den eigenkapitalwert an den Börsen gefunden. Gleichzeitig zeigten die Forscher aber schon damals, dass mit steigendem Frauenanteil im Aufsichtsrat das unternehmensrisiko sinkt. Dies stärkt die position der Fremdkapitalgeber, die sich häufig mehr für ein niedrigeres risiko als für kurzfristig höhere Gewinne interessieren. Die neue Studie von riepe und Yang konzentriert sich nun auf die wechselwirkung zwischen unternehmensrisiko und der Bewertung der unternehmensverschuldung, zwei wichtige Bestandteile der unternehmensperformance. Anhand von Daten uS-amerikanischer unternehmen wiesen die wissenschaftler einen positiven Zusammenhang zwischen mehr Frauen in Führungsgremien und dem wert von unternehmensanleihen nach. Die positiven Auswirkungen auf den wert der unternehmensverschuldung hatten sich in ihrer früheren Studie bereits abgezeichnet.
Negative Effekte auf Messverzerrungen zurückzuführen
Im zweiten Schritt werteten die Forscher die empirische Literatur aus. Sie stellten fest, dass Studien, die einen Zusammenhang zwischen Frauen in Leitungsgremien und negativer unternehmensperformance aufzeigten, alle die positiven Auswirkungen von mehr Frauen auf den wert der unternehmensverschuldung vernachlässigten. Die negativen Marktwertveränderungen für die Aktionäre aus niedrigerem risiko werden dort selektiv herausgegriffen, die positiven Auswirkungen auf den wert der unternehmensverschuldung werden ignoriert, indem lediglich die Buchwerte des Fremdkapitals betrachtet werden. Diese Vernachlässigung der wertveränderung der unternehmensschulden verzerrt die ergebnisse wesentlich: die so genannte „Book Value Bias of Debt“. Die Buchwert-Verzerrung kann leicht zu falschen statistischen Schlussfolgerungen führen. Mit diesen erkenntnissen berechneten die Forscher zwei große Studien neu. nach Bereinigung der ergebnisse konnten sie keinen signifikanten Zusammenhang mehr zwischen Frauen in Leitungsgremien und einer negativen unternehmensperformance feststellen. „Der messbare negative effekt auf den Börsenwert des unternehmens ist sehr schwach. Im hinblick auf die erkenntnis, dass mit dem Anstieg des Frauenanteils im Aufsichtsrat das unternehmensrisiko sinkt, kann eher von einem positiven als von einem negativen effekt auf die unternehmensperformance ausgegangen werden“, sagt riepe. „Insgesamt führen wir einen großen teil des in Studien festgestellten Zusammenhangs zwischen Frauen in Leitungsgremien und negativem Börsenwert auf diese Messverzerrungen zurück. Der effekt auf eine Senkung des risikos, der den nachhaltigen unternehmenserfolg beeinflusst, bleibt jedoch bestehen.“

Diversity in diversity policy : The case of the Scandinavian countries

Inhalt: The Scandinavian countries, i.e. Denmark, Norway and Sweden are often described as European leaders within equal opportunity and diversity. However, in spite of the fact that the Scandinavian countries have implemented policies and initiated programmes to ensure gender diversity in all sectors and levels of society since the mid-1970s and beginning of the 1980s, progress is generally slow. Nonetheless, the three countries differ regarding public and political attention on the issue and hence on policies, intensity of implementation and management of gender equality policies. In this article, we focus on the representation of Scandinavian women in leadership positions in larger companies and academia, and discuss the scope and intensity of gender equality policies and their effects. Finally, we highlight key lessons learned from decades of gender equality work in the three countries.

Inhalt: Scientific excellence and equal opportunities have been on the agenda for more than a decade now, raising serious doubts on the functioning of meritocracy as the major principle of assigning merit within academia. Our discourse analytical study of twelve expert interviews shows how both discourses are interrelated, thereby creating different perspectives on meritocracy and universities as organizations. Our analysis reveals three major discursive « meetings » of the two concepts : While in a first « meeting », excellence and equal opportunities are seen as fundamentally contradicting concepts and meritocracy in universities remains taken for granted, in a second meeting, the notion of scientific excellence and especially the norm of the male ideal researcher is criticized and hence the relationship between excellence and equal opportunities is problematized. In a third meeting, excellence is seen as highly dependent on equal opportunities, turning around the so far hierarchical relationship between excellence and equal opportunities. There are three major differences in the consequences of each meeting. First, meritocracy is either debated or taken for granted. Second, the focus shifts from individual researchers to selection criteria and finally the strategic aspect of positioning universities in a competitive market. Furthermore, while the focus is on women in the first meeting and shifts to critiquing procedures in the second, institutional change is at the heart of the third meeting. Our analysis hence shows that there is a greater variety of interplays than often talked about that offer different and even new ways forward.

Gender in academic STEM: A focus on men faculty

Inhalt: In this study, we explore how men faculty understand the role of gender in shaping faculty experiences in academic science, technology, engineering and mathematics (STEM) and how they position themselves in relation to inequalities disfavouring women. Our data reveal diversity among men in their understandings regarding challenges facing women in STEM. The majority of our participants revealed gender‐blind perspectives and argued that the egalitarian structure of academia does not allow gender to impact attainments in STEM in any significant way. However, a considerable number of them felt privileged compared to women and described subtle ways in which gender shapes opportunities. Our findings show the important implications of men's sensitivity to gender in the ways they perform their professional roles as, for example, mentors, colleagues and teachers in relation to women in STEM. They further call for attention to men's perceptions of gender issues when designing institutional interventions for improving women's conditions in STEM.

The gendered modus operandi of the illiberal transformation in Hungary and Poland

Inhalt: Based on a comparative analysis of the ideological and policy tools of illiberal ruling parties in Hungary and Poland, this paper makes the case that the 21st century Central European illiberal transformation is a process deeply reliant on gender politics, and that a feminist analysis is central to understanding the current regime changes, both in terms of their ideological underpinnings, and with respect to their modus operandi. It argues that: 1. opposition to the liberal equality paradigm has become a key ideological space where the illiberal alternative to the post-1989 (neo)liberal project is being forged; 2. family mainstreaming and anti-gender policies have been one of the main pillars on which the illiberal state has been erected, and through which security, equality and human rights have been redefined; 3. illiberal transformation operates through the appropriation of key concepts, tools and funding channels of liberal equality politics which have been crucial to women's rights. The article describes some new and distinct challenges illiberal governance poses to the women's rights, feminist civil society and emancipatory politics in Hungary and Poland.
